Hosting

This website is hosted on a server of Hetzner Online GmbH, Industriestraße 25, 91710 Gunzenhausen, in its data centre in Nuremberg. Hetzner provides the server and the network connection and processes the data arising in this context exclusively on our behalf (Art. 28 DSGVO). The data does not leave Germany in the process.

No Cookies – Storage in the Browser Only at Your Request

This website does not use cookies. Only if you yourself use a function does the page store a small piece of information in your browser's storage (localStorage):

• Watch list: the numbers of the properties you have saved;
• WhatsApp notice: the fact that you have closed the notice window, so that it does not appear again.

This information remains in your browser and is not transmitted to us. You can delete it at any time via your browser settings. The legal basis is § 25 Abs. 2 Nr. 2 TDDDG, as the storage is strictly necessary for the function requested by you.

When You Contact Us

If you contact us with an enquiry via a form, by e-mail, by telephone or via WhatsApp, we process the information you provide to us – as a rule, your name, e-mail address, telephone number, your message, the property concerned and the page from which the enquiry was sent.

We use this data to respond to your enquiry, to send you property documentation and to assist you in the purchase, sale or rental of a property. Your enquiry is received by the employee responsible for the property. After submitting a form, you will receive a confirmation containing a copy of your information and our cancellation policy (Widerrufsbelehrung); we retain a copy of this confirmation as proof.

The legal basis is the performance of pre-contractual measures and of the brokerage agreement (Maklervertrag) (Art. 6 Abs. 1 lit. b DSGVO). We store your data for as long as the assistance continues and thereafter for as long as statutory retention obligations require (as a rule, six or ten years under commercial and tax law, Art. 6 Abs. 1 lit. c DSGVO).

In order to be able to suggest suitable offers to you, we internally compare your enquiries – and, if you have already purchased through us, your previous purchases – with our current properties. This takes place exclusively within our company; no automated decision is made about you. The legal basis is our legitimate interest in assisting our clients (Art. 6 Abs. 1 lit. f DSGVO); you may object to this at any time.

Search Profile

If you create a search profile, we store your e-mail address, the language and your search criteria and send you new matching properties by e-mail. The legal basis is your consent (Art. 6 Abs. 1 lit. a DSGVO).

Each e-mail contains a link with which you can change the search profile or unsubscribe. Upon unsubscribing, you will receive no further e-mails; upon request, we will delete the profile completely.

E-mail Dispatch and Mailboxes

The e-mails sent by our website – forwarding your enquiry to us, the confirmation to you and messages about search profiles and commission agreements – are sent from our server in Germany via the sending service of Google Workspace (Google Cloud EMEA Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Google processes the messages on our behalf (Art. 28 GDPR); the transmission is encrypted. Where data is transferred to the USA in this context, this is based on the European Commission's adequacy decision on the EU-US Data Privacy Framework, under which Google is certified.

Our mailboxes with addresses at immobiliya.de are provided by Google Cloud EMEA Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google Workspace). Google processes the e-mails on our behalf. To the extent that data is transferred to the USA in this context, this takes place on the basis of the adequacy decision of the EU Commission on the EU-US Data Privacy Framework, under which Google is certified.

Links to WhatsApp, Telegram, Viber and Google Maps

On our pages you will find links to WhatsApp, Telegram and Viber as well as to Google Maps. These are simple links: as long as you do not click on them, nothing is loaded from these providers and nothing is transmitted to them. The QR code for WhatsApp is generated by your browser itself, without any connection to a third-party server.

Only when you click on such a link do you leave our website or open the provider's app. The provider's privacy provisions then apply, for example those of WhatsApp Ireland Limited or Google Ireland Limited.

Encryption

The entire website is delivered exclusively in encrypted form via HTTPS (TLS). Data that you enter into our forms is transmitted in encrypted form.

Your Rights

You have the right at any time to obtain information about the data stored by us (Art. 15 DSGVO), to rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20). You may withdraw any consent given at any time with effect for the future (Art. 7 Abs. 3).

Right to object: To the extent that we process data on the basis of our legitimate interest (Art. 6 Abs. 1 lit. f DSGVO), you may object to this processing at any time on grounds relating to your particular situation (Art. 21 DSGVO).

You also have the right to lodge a complaint with a data protection supervisory authority. The authority competent for us is the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit), Alt-Moabit 59–61, 10555 Berlin.

Obligation to Provide Data

You are not obliged to provide us with personal data. Without a means of contacting you, however, we are unable to respond to your enquiry.
