Frequently asked questions
Can I buy property in Berlin as a foreigner?
Yes. German law imposes no restriction based on nationality or place of residence on the purchase of a flat or house; buyers from the EU and from non-EU countries buy on the same terms. Exceptions apply to persons on sanctions lists. The notary and the agent are required to verify your identity under the Money Laundering Act (Geldwäschegesetz); for this you need a valid passport or identity card.
Which estate agent in Berlin helps buyers who do not speak German?
L&B Immobiliya in Berlin-Friedrichshain has been advising in German, English, Russian, Ukrainian and Italian since 2009, translates the documents, arranges the interpreter at the notary and can represent you under a power of attorney.
Do I have to come to Germany for the notary appointment?
No. Notarisation by video is currently not permitted for property purchase contracts, but you can be represented under a power of attorney. The power of attorney must be at least publicly certified; abroad, this can be done at a German mission abroad or by a local notary with an apostille.
Is the purchase contract valid if I do not speak German?
Yes. The notary must ensure that you understand the contract. If your German is not sufficient, the contract is translated by an interpreter at the appointment (§ 16 Beurkundungsgesetz). We arrange this.
What does buying a flat in Berlin cost in addition to the purchase price?
Real estate transfer tax 6.0 %, notary and land register together approx. 1.5 to 2 % and, where applicable, the agent's commission as stated in the exposé. For flats and single-family houses, the buyer pays no more commission than the seller (§ 656c BGB).
Do you only broker in Berlin?
No. Our office is in Berlin, but we broker residential and commercial properties throughout Germany.
Do you also help owners abroad with selling?
Yes. We value the property free of charge and without obligation, handle the marketing and support the sale through to the notary – even if you are unable to travel to Germany.
